Working closely with the firm’s real estate group, Siegel Brill’s land use team has the skills, experience and resources to navigate the often complex areas of development, land use and real property law. Our objective is to help clients overcome the political, environmental and economic barriers to development and property utilization.
Permitting & Zoning
Our land use attorneys frequently work with clients in obtaining local land use permits and related state and federal permits. We maintain close contact with government officials and staff to facilitate the process and ensure a beneficial resolution. Siegel Brill has established relationships with regional authorities including;
- State environmental boards
- Regional development agencies
- County, township and municipal boards and planning commissions
We also assist clients with complex environmental aspects of permitting, including the preparation and management of Environmental Assessment Worksheets (EAW), Environmental Impact Statements (EIS), and Alternative Urban Areawide Reviews (AUAR).
When your desired use for a property conflicts with governing zoning ordinances, Siegel Brill takes an aggressive approach in obtaining the variances, zoning amendments, and comprehensive plan amendments that will launch your development plans.
We use extensive knowledge of municipal law, zoning procedure, and administrative rules (e.g., the “60-Day Rule”) to develop a strategy for success. We implement that strategy by representing clients in application materials, stakeholder meetings and government hearings.
We also have specific experience dealing with moratoria, subdivision ordinances, zoning overlay districts, and “open space” ordinances presenting unique challenges to development. In addition, we monitor community zoning activity that may affect anticipated future use of property.
Economic development

Our land use practitioners provide knowledgeable assistance to clients pursuing tax increment financing, tax abatement arrangements, and community development grants. We also aid clients in structuring development agreements to clearly define the public and private responsibilities to maximize the success of a development. We also provide counsel and representation concerning assessments and appeals.
